Business identity

KytherIQ is the business name of Tristin Von Gunten d/b/a KytherIQ, based in Florida. References to “KytherIQ,” “we,” “us,” or “our” mean that business.

Scope in writing

Before any paid work, we send the scope, deliverables, price and timing in writing. Work starts when you approve it. Changes to scope are agreed in writing before they are billed.

No guaranteed results

We do careful work, but we don't guarantee outcomes we don't control: bids won, calls, texts answered, rankings, reviews, revenue or savings.

Your accounts

You own your accounts and data. We work as a manager in your accounts, never as the owner, and never ask for your passwords. See Your accounts.

Texting rules

For missed-call text-back, you agree to text only people who called your business and to honor STOP requests. We add opt-out wording to every first text.

What a bid from KytherIQ is, and isn't

Everything KytherIQ produces for estimating is an estimate prepared for your review. It is not a contract, not an offer, and not a guarantee of final cost. KytherIQ is not a licensed contractor and does not perform construction work. Bids go out under your company name and, where your trade requires one, your license. You are responsible for reviewing and approving every bid or proposal before it goes to your customer, and for the accuracy of the details, prices, quantities and approvals you give us.

Pricing is based on visible conditions and the information provided. Conditions discovered later may change scope or price.

What we do and don't do

KytherIQ does office work for your business: bids, missed-call text-back, websites, listing fixes, spend reviews and small custom tools. We don't do regulated work: no inspections, engineering, testing, certification, legal, accounting or tax advice, and no government compliance decisions. That work stays with the licensed professional or authority. Anything labeled "in discovery" on this site is not for sale yet.

Delivery dates

When a written delivery date is provided, the clock starts when KytherIQ has the information reasonably required to perform the work. Time spent waiting for requested information may pause the delivery schedule.

Payment

Unless otherwise stated in writing, work may be invoiced before it begins. Payment is made by card or Apple Pay through Stripe. Any processing fee will be disclosed before payment. Website or custom-build payment schedules may be stated separately in the applicable quote or invoice.

Canceling and revisions

Monthly services renew each month until canceled. You can cancel at any time by text or email (tristin@kytheriq.com, 754-654-9449); the service stops at the end of the current paid month. There is no cancellation fee. If your written agreement includes a minimum commitment, that commitment still applies. One-time work already delivered is generally non-refundable, but KytherIQ will correct material errors in its own work. Included revision rounds, if any, are stated with the service. See Refunds.

Your material

You keep ownership of photos, price books, contracts, job data, and other materials you provide. KytherIQ retains ownership of its pre-existing tools, methods, templates, and internal systems unless otherwise agreed in writing.

KytherIQ SMS terms

Program name: KytherIQ. Messages are sent by Tristin Von Gunten d/b/a KytherIQ.

How you join: You may voluntarily opt in on the public KytherIQ quote form by entering your mobile number and selecting the separate SMS consent checkbox. The checkbox is unchecked by default. SMS consent is optional, separate from acceptance of these Terms and the Privacy Policy, and is not a condition of purchase or use of KytherIQ's services.

Message types: Depending on what you request, messages may include customer-service responses, missed-call follow-ups, appointment confirmations and reminders, scheduling updates, service-related notifications, and other communications you specifically requested. This web-form opt-in does not enroll you in promotional marketing messages unless KytherIQ separately asks for and receives the additional consent required for those messages.

Frequency and charges: Message frequency varies based on your interaction with KytherIQ. Message and data rates may apply. Your wireless carrier's terms and charges apply.

Opt out: Reply STOP to opt out of the KytherIQ SMS program. After an opt-out request, KytherIQ may send a one-time confirmation message and will stop further program messages unless you later opt in again.

Delivery: Mobile carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier availability and network conditions.

Privacy: Mobile phone numbers and SMS opt-in consent are not sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. See the KytherIQ Privacy Policy for details.

Acceptable use

You may not use KytherIQ services to violate law, infringe the rights of others, impersonate another person or business, send unlawful or unauthorized communications, or interfere with the security or operation of KytherIQ systems.

Disclaimers and limits

KytherIQ services are provided on the basis described in the applicable quote, invoice, or service description. To the fullest extent permitted by law, KytherIQ is not responsible for indirect, incidental, special, or consequential losses arising from use of the services. Any direct liability will be limited to the amount paid to KytherIQ for the specific service giving rise to the claim, except where applicable law does not allow that limitation.

Florida law

These terms are governed by Florida law. Unless applicable law requires otherwise, disputes relating to KytherIQ will be handled in Broward County, Florida.

Changes to these terms

KytherIQ may update these terms as its services or legal obligations change. The effective date below identifies the current version. Material changes to the SMS program will not replace the need for legally required consent.
